Advocate Files Plea in SC Seeking Establishment of Bar Council in J&K & Ladakh

A practising Advocate from Jammu and Kashmir and Ladakh has approached Supreme Court seeking establishment of the Bar Council in Jammu and Kashmir and Ladakh.

It has been argued in the Petition that the entire legal fraternity in Jammu and Kashmir and Ladakh has no government established body where they can get themselves enrolled and take benefits of the Bar Council as like other states of India”.

Currently, the members of the Legal Fraternity take the membership of Jammu and Kashmir High Court Bar Association and all their grievances are dealt by the above mentioned Bar Association but due to the system of “Darbar Move” the members are facing various difficulties , the Plea states.

Contending that due to non-availability of State Council, the Advocates are deprived of applying for proximity cards for appearing before the Top Court.

The Advocate in the Petition has sought for directing the SC to issue proximity cards to advocate members from Jammu and Kashmir and Ladakh who wish to avail the benefit of proximity card.

The Petitioner stated that it had approved J&K Rules but irrespective of the same, BCI has not made any efforts to establish the State Bar Council.
