Calcutta HC bans use of firecracker

The Telangana Fire Work Dealers Association has filed a plea in the Supreme Court challenging the High Court’s order to ban firecrackers ahead of the festivals.

The petition has stated the grievance of the Association that it was not a party in the proceeding while the High Court ordered the ban.

The ban without hearing their side would affect the livelihoods of the Association.

It was a clear violation of the principle of natural justice as the Association did not get the opportunity to represent itself in the Court.

The plea stated that the business was their source of income, and banning on such short notice would create immense hardships for the lives of the members of the petitioners, violating their fundamental rights under Article 19 and 21.

The Association is being represented by Advocates Pranav Diesh, Mohammad Ibrahim, and CH Jayakrishna and Advocate-on-record Somanadri Goud Khatam.

The Telangana High Court had ordered to impose a ban on the manufacturing and use of firecrackers in the wake of the pandemic.
