A single-Judge Bench of Justice Sanjay Kumar today granted bail to three accused of duping former Chairman of Bar Council of Punjab and Haryana of Rs.3.58 Lakh on the pretext of renewing insurance policies.

An FIR was registered against Suman Kumar, Karan Singh and Sonu at the Sector-19 police station.

All three have furnished personal bonds for Rs.2 Lakh each and two sureties for a like sum on the condition to rejoin the investigation whenever required by the Police authorities.

In January 2020, the Cyber Crime Investigation Cell of Chandigarh arrested 10 people on the complaint of Chander Mohan Munjal for allegedly running a fake call centre for cheating people on the pretext renewal of insurance policies.

In February 2020, the victim and accused signed a compromise deed whereby the accused returned all the money they had taken from the victim on the promise of quash of proceedings against them, which was filed in the High Court.

The HC directed the Magistrate to confirm whether the deed is genuine and the report is still awaited.

The Court stated, “That being so, this court is not inclined to accept that the compromise effected with the complainant would be reason enough to infer that the fate of this case is doomed and that the petitioners would automatically be entitled to release on bail… The compromise, in itself, may therefore not be reason enough to bring down the curtains. However, as matters stand, the investigation seems to have been completed to a great extent insofar as the present FIR is concerned and recoveries have also been effected.”

The Hon’ble Court also observed that there is no point in continuing the custody of the accused after the compromise but the accused persons’ involvement in the crime cannot be ignored until the investigation is concluded.
