Bombay High Court Dismisses Govt Request Seeking Entry Relaxation in State

The Goa bench of Bombay High court dismissed application filed by the State of Goa seeking to modify the order restricting the entry of persons into the state without a Covid-19 Negative test report.

While the court had ordered the state to restrict persons entering in the state who don’t have a negative COVID-19 report prior to 72 hours of such entering, the state government moved an application in the Court contending the same may not be feasible in the present scenario.

The court observed that despite the order was quite clear and unambiguous, the District Magistrates of the two districts comprising the State of Goa, proceeded to issue orders dated May 8, virtually defying Court’s orders and proceeding to carve out, either by themselves or otherwise, the exceptions in favor of certain categories of persons.

In conclusion, the Court observed that since there was a material on record that the medical infrastructure in the State is quite over-stressed, if no restrictions will be made, there can be a collapse in medical infrastructure.

The application filed by the State government was thus dismissed.
