BACKGROUND

Adv. Dave is a Supreme Court senior lawyer and has commanded practice across the Indian subcontinent. He had been working under the Bar for over 3 decades. He was constituted as a member of the National Legal Services Authority (NALSA) for legal aid promotion under an Act of the Parliament. Currently, he’s a member of the American Arbitration Association (AAA) board, the Council of the International Council of Commercial Arbitration (ICCA), and the Foundation for International Arbitration Advocacy of Switzerland (FIAA). He’s also the International Bar Association’s Arbitration Committee’s Vice-Chair. He worked for the London Court of International Arbitration (LCIA) from the years 2003 to 2003. He’s also LCIA’s Asia Pacific Users Council.

UPBRINGING & EDUCATION

Mr. Dushyant Dave pursued his Bachelor’s of Commerce from the University of Gujarat in the year 1975. He went onto study and collect his LLB degree from the University of Gujarat in the batch of 1978.

WALK OF LIFE

Mr. Dave Dushyant had practised as a Supreme Court’s senior advocate since 1994 at several High Courts, tribunals and different courts and at New Delhi. He currently works at his own chambers as a senior lawyer at the SC.

He’s been involved in several disputes in relation to foregin collaborations, some financial transactions, public law claims, technology laws and so on. He was appointed as the Amicus Curiae at the Supreme Court in different matters that included public and constitutional law.

He’s practiced law since 1980 to 1994 at the Gujarat High Court and several other courts in and around Gujarat, particularly diverse litigating subjects such as some commercial laws (for example., contract, sale of goods, transfer of property, intellectual property laws, and taxation laws), constitution and public law, arbitration law, administrative law, and employment and industrial law.

He had served in different contract disputes such as collaboration and technology transfer agreements and has counseled in matters involving domestic and international commercial arbitrations. Mr. Dave has extensive experience in matters such as appointments as well as removals of arbitrators, interim measures of protection, challenges and enforcement of awards, and so on.

LANDMARK JUDGEMENTS

Sr. Adv. Dushyant Dave has appeared a few times for the controversial and well-known cases. One of them being the “Love Jihad” case as dubbed by the media. It was about a 25 year old woman who converted to Islam after she married a Muslim man and her marriage was annulled by the Kerala High Court. It was later refurbished by the Supreme Court of India.

CONTROVERSIES –

Sr. Adv. Dushyant Dave’s controversial run for the presidency of the Supreme Court Bar Association (SCBA) and his reluctant win over the rest of the candidates involved in the position is worth mentioning. He has recently resigned from the said position as well after holding it for quite some time.
