The Bombay High Court recently ordered a wife to pay Alimony to her ex-husband, stating that either spouse can seek alimony under the Hindu Marriage Act.
A local Court in Maharashtra’s Nanded had previously ordered the woman to pay 3,000 to her divorced husband, who is in financial need.
The orders of the local Court were upheld by the Bombay High Court. After 23 years of marriage, the couple divorced in 2015. The wife is a university professor.
The couple married in 1992 and divorced in 2015 after the wife filed a cruelty claim in Court.
The husband then filed a Petition for alimony in the amount of $15,000 per month, claiming he had no other source of income.
He claimed he encouraged his wife to continue her education while he ran the household.
The wife claimed that her husband owns a grocery store and earns money by leasing out his auto-rickshaw, all while caring for their daughter.
The Wife’s counsel had objected to the alimony claim, claiming that while the divorce was granted in 2015, the ex-husband sought alimony in 2017.
The High Court rejected the argument, stating that alimony can be sought at any time.
Until the permanent alimony of 15,000 per month is decided, the woman was ordered by the Civil Court to pay 3,000 in maintenance, which was upheld by the Bombay High Court.
