Supreme Court imposes Rs 1 lakh cost on Saritha Nair Plea against Rahul Gandhi

Dismissing a Plea filed by Saritha S. Nair Supreme Court imposed a cost of Rs 1 lakh and called as frivolous.

Saritha S. Nair challenged the election of Congress leader Rahul Gandhi from the Wayanad constituency in supreme court.  

Supreme Court Bench said,“We are going to impose cost on you for this frivolous case,”.

Earlier Kerala High Court rejected Saritha Plea and said that the returning officer has rightly disqualified her from contesting the election from the Wayanad Parliamentary constituency as well as the Ernakulam Parliamentary constituency.

High Court in accordance with Article 102 of the Constitution of India, dealing with disqualification for membership.

Saritha is accused of solar scam and Perumbavoor first class magistrate court sentenced three years imprisonment and a penalty of Rs 10,000 to her.  

Also in another case, Pathanamthitta judicial fist class magistrate court had imposed a Rs 45 lakh fine on her. The returning officer rejected her nomination to contest from Wayanad Lok Sabha Constituency.

Kerala High Court had rejected her petition on that ground only as she accepted that he sentence was stayed and she had not pressed against her conviction.

“Therefore, at the time of submitting the nominations, petitioner was having the disqualification in terms of Sec.8(3) of Act, 1951. Accordingly, the election petitions are liable to be dismissed also on the basis of the said preliminary issue raised,” held by the High Court.
