SC rejected Plea for the rebuilding Religious structures damaged during demolition of Telangana Secretariat

Today Supreme Court Of India rejected and refused to entertain a petition for the rebuilding of the religious structures damaged during the demolition of the Telangana secretariat.

While allowing the petitioner to withdraw the petition, the Two Judges Bench of Justices Ashok Bhushan and R. Subhash Reddy quoted that :  “It is a misconceived prayer. We can not allow all this under Art 32.”

Advocate Khaja Aijazuddin filed the petition and alleged that there were two mosques and one temple that were damaged during the demolition of the secretariat building.

The contentions of the petitioner was that the religious buildings were damaged since a very long time and this amounts to deprivation of fundamental rights of Indian citizens provided under Articles 14, 21, 25 and 26 of the Indian constitution. The petitioner further contended that it is the duty of the state to preserve all the religious structures and also to restore them at the place where they previously existed.

It was further said that the government had launched a new plan for the building of a new secretariat while nothing has been said about the rebuilding of damaged mosque and the temple till date.

The petitioner, urged the court to direct the state for preserving all the religious structures in accordance with the law.
