Petition to abrogate Epidemic Disease Act: Bombay HC ask deposit of RS 1 lakh as precondition

A division bench of Chief Justice (CJ) Dipankar Datta and Justice Girish S Kulkarni of the Bombay High court on Wednesday directed the petitioner to deposit Rs 1 lakh within a week as a pre-condition to hear the petition.

The petitioner requested in the petition to set aside the Epidemic Diseases Act while the number of people affected with covid cases is increasing day by day in India.

The public litigation petition was filed by advocate Harshal Mirashi, questioning the constitutional validity of the Epidemic Diseases Act, 1897 and the petition also ask to halt the covid restrictions and direction in immediate way.

The petition state that the covid -19 is only a cough and cold and it is only for undue profit through making fear in people’s mind .

CJ Datta said that ,

“We will hear you, but only after you deposit heavy security for filing such a frivolous petition. If you succeed, you will get the security amount,”

The court would observe that the petition will wastage the precious time of court

The court ask about the figures of covid cases to advocate Mishra and directed him to deposit the amount of RS. 1 lakh within one week with registration .
