A special bench of Madras High court which was constituted to conduct the trial of the Sathankulam custodial death case decided on the jurisdiction of the court.
High Court held that the Madurai chief judicial magistrate would commit the case to the Madurai principal district court for trial.
A Division Bench of Justices M Sathyanarayanan and V Bharathidasan passed the order.
The Tuticorin PDJ had asked for clarification to the HC Bench as the bail applications of the accused in this case are being considered and disposed of by the Madurai principal district court.
Earlier, the special public prosecutor for CBI cases objected to the hearing before the Tuticorin PDJ and stated that the chief judicial magistrate at Madurai is designated to try the offences.
CBI’s public prosecutor, who had completed the investigation in the case, filed the final report against nine policemen before the Madurai chief judicial magistrate court and decided that the Madurai chief judicial magistrate would commit the case to the Madurai principal district court for trial.
