The High Court of Delhi issued a notice in a plea against the appointment of Special Public Prosecutors in the Delhi violence.
Justice Navin Chawla has issued notice to all the respondents and has impleaded Home Affairs Ministry to be a party in the case.
The single-bench was hearing a petition filed by the Delhi Prosecutors Welfare Association (DPWA) asking to quash the appointment of 11 SPPs made by the state government in the Delhi riots case.
The appointment made under the Delhi government’s notification, recommended by the Delhi Police, had violated the objectives mentioned under Section 24 of the Criminal Code of Procedure (CrPC).
According to the plea, there were differences between the Lt Governor and the government on the appointment of SPPs. The Lt Governor then proceeded with the recommendation made by the police.
The plea stated that there are no criteria mentioned to select SPPs based on their experience. Therefore, the appointment made on the recommendation of the Delhi Police violates Article 21 of the Constitution of India of seeking a free and fair trial.
