Woman who claimed Money from Church on Printing Bibles lost Claim twice

A woman who had testified in Court that she took part in the publication and printing of Bibles has for the second time lost the appeal to claim Sh2 Million from a Church.

Alice Wanjiru Ruhiu approached the Court to seek payment of Sh 2,441,700 and stated that she was not paid on behalf of the Messianic Assembly of Yahweh.

The Church had shown its denial in paying the balance despite having funds and in order to preserve the cordial business relationship with the printing company.

Ms Wanjiru filed an appeal in the Court of Appeal after which she lost the case to the church. 

In her second appeal, she contended that the Trial Court had failed to take into consideration that she was an integral part of the production team.

The woman further stated that when she was selected by the Church she was entitled to reimbursement for the expenses incurred in production costs amounting to $24,417.19 (Sh2, 660,252.85).

Wanjiru testified that on April 24, 2013, that the Church made a contract with a party where the Church called the woman to negotiate the printing of the Swahili version of Bibles. She said the parties agreed to print 16,000 copies for $96,900 (Sh10,557,255).

Responding to the contentions Bishop Peter G. Kihara representing the judge stated that the Church had come under a contract only with Bible Africa for the production of Bibles and in which the signatories to the contract were Rev Alexander Wanjenga of Bible Africa, which also entered into a contract with Wanjiru.

Further, the Church contended that Wanjiru had acted as a representative, servant, and/or agent of Bible Africa and that all financial obligations due and owing from itself to Bible Africa for the printing of the Bibles the transaction of the same was completed and the Church did not owe her any money.

Wanjiru in her submission said that the Church owes her money for working as an appointed agent to coordinate the production and publication of the Bibles.

The Court highlighted the witness statement given by Wanjiru, that upon payment of the 75 per cent by the Church to Bible Africa, she had received the payment of $27,555 the Court stated that there was no agreement between the woman and the Church hence dismissed her appeal.
