The Delhi High Court has ruled that it is not acceptable for Courts to make Statements that Criticize Police action unless those words are consistent with the Case.
Case Title: SURENDER KUMAR Vs. STATE OF NCT OF DELHI
Justice Jasmeet Singh Quashed the Court of Appeals’ arguments against the Investigating Officer (IO) in the Criminal Review Case. The Application was filed by the Investigation Officer seeking the Reversal of the Court of Appeal Order to begin Investigating him.
The coroner Investigated the Murder Case, and the Court ruled that the Detective’s conduct was based on the fact that he had met the suspect in order to misuse the Powers of the Municipal Magistrate without disclosing the relevant Facts of the Order he wanted through Forum-Shopping.
The trust was placed on the applicant in the decision of the High Court in Pramod Kumar Jha Vs. State of Bihar & Another and the decision of the Delhi High Court by Mohd. Mehandi Shah Vs. State.
The Court therefore noted that a sudden examination of the Order issued by the Additional Solicitor General clearly showed that the Plaintiff was not present before the Tribunal.
“Making such sweeping and castigating remarks against him without even giving an opportunity to him to explain his conduct, is incorrect. It is further undesirable for Courts to make remarks censuring the action of Police Officers unless such remarks are strictly relevant for the Case,” the Court observed.
Accordingly, the Court disposed of the Plea by expunging the remarks in question.
