Umar Khalid Arrested in UAPA Case, Seeks Interim Bail for 2 Weeks to Attend Sister’s Wedding [Delhi Riots]

A special court dealing with Delhi riots cases recently sought the prosecution’s response after Umar Khalid moved an interim bail plea for two weeks in the Unlawful Activities (Prevention) Act (UAPA) case against him.

The plea was filed before Additional Sessions Judge Amitabh Rawat, who posted the hearing to November 25.

“This is a fresh application under Section 439 CrPC (Code of Criminal Procedure) moved on behalf of applicant/accused Umar Khalid seeking interim bail for a period of two weeks,” stated the order passed on November 18.

The court sought response from the prosecution after verification of the material mentioned in Khalid’s application. “Put up for filing of reply and arguments on the interim bail application of applicant/accused Umar Khalid on 25.11.2022,” the Court said.

On October 18 this year, the Delhi High Court had rejected Khalid’s bail plea, noting that the allegations against him were “prima facie true” and therefore the restriction of Section 43D(5) of the UAPA was fulfilled during the consideration of bail was kind of applicable.

Delhi Police arrested Khalid in this case on September 13, 2020 and filed a charge sheet against him on November 22 the same year under various sections of the UAPA and the Indian Penal Code. 

Khalid filed a bail application in July 2021, and after several hearings, the trial court rejected his application on March 24, 2022.  He then approached the Delhi High Court in appeal.
