Supreme Court sentences a rapist to death and rules that the Death penalty cannot be completely abolished

 The Supreme Court sentenced a man from Rajasthan to death for raping and killing an eight-year-old girl with mental and physical disabilities in 2013, ruling that the death penalty cannot be entirely avoided.

A Bench comprising Justice A.M. Khanwilkar, Justice Dinesh Maheshwari and Justice C.T. Ravikumar ruled, it would be detrimental to the whole system for maintaining order in society to abolish the death penalty in all cases and put it to rest in silence.

According to the Apex Court, in some circumstances, a death sentence must be given in order to uphold the rule of law and preserve the objectivity of the judicial process.

It further stated that a Court was not required to request reports on psychological evaluations or the potential for reformation of a convict at every stage, particularly when there were compelling reasons to demonstrate the convict’s perverse behaviour.
