Tahir Hussain who was a councillor of Aam Aadmi Party (AAP) got acquitted by Delhi Court from the charge of defacement of public property in 2015.

Under section 3 of Delhi Prevention of Defacement Property Act the case was registered.

The Head constable of Karawal Nagar had saw a flex over electric pole.

It was alleged that he had put it up in which he was wishing Happy New Year to the public.

While hearing the case Chief Metropolitan Magistrate observed that there is no evidence which shows that he had put this hoarding or any one else done this on his instructions.

“In fact, the IO has failed to point out in the chargesheet as to how he had pinned down at the name of the accused as the installer of the Board Ex. P3, in as much as, he has neither recorded the statement of residents of the locality where the board in question was found affixed by the police, nor has he recorded the statement of the printer,” said by the Court.

In the cross examination only it was stated that enquiries were made regarding who installed it but no one could tell the name and address of the such persons

“Thus, in the absence of any proof as to the installation of the alleged board by or at the behest of the accused, much less, the proof beyond reasonable doubts qua the said fact, there is no question of the accused being guilty for the offence of defacement of the property within the meaning of Section 3 of DPDP Act,” held by Court
