Supreme Court pulls up Tripura Police for not complying with its order

The Supreme Court of India on February 7, 2022 warned the Tripura Police in regards with the matter of the Police sending notices to people alleging that their posts are based on Communal violence. Earlier the Apex Court passed a restraining order, which was not followed by the Police.

The Supreme Court Bench of Justices D Y Chandrachud and Surya Kant was hearing a plea of a journalist named Samiullah Shabbir Khan, who alleged that the Police had issued a notice against him, within which he was asked to appear under Section 41A (Notice to appear before police officer) of the Code of Criminal Procedure.

The Counsel for the Petitioner, Advocate Sharukh Alam, cited an order of the Top Court from January 10, 2022. The Order from the hearing of February 7, 2022 stated that, “The counsel for the petitioner, states that the order dated 10 January 2022 passed by this court, though reported widely, has formally remained to be served on the superintendent of police.”

The Supreme Division Bench stated that, “When we have passed an order, how dare you not implement it. We will ask your Home Secretary and other officers to be present on the screen next time. At least show deference to our order when we have handled an issue.”

The Bench furthermore added, “Inform the Superintendent of Police not to harass people like this. Why should somebody be required to run to the Supreme Court? What else is this if this is not harassment? Otherwise, we will call SP to court and make him answerable if we find he is trying to evade compliance by issuing notices to the people.”

The Supreme Court Division Bench was given assurance by the Solicitor General of India, Tushar Mehta, that compliance will be given to the Order of the Apex Court by the Tripura State Police.
