Supreme Court dismisses Appeal against Dinkar Gupta’s appointment as Punjab DGP

On Tuesday, the Supreme Court dismissed pleas challenging the Punjab and Haryana High Court’s decision affirming Dinkar Gupta’s appointment as the State’s Director General of Police. 

The Appeals filed by IPS officers Siddharth Chattopadhyay and Mohammad Mustafa, who challenged Gupta’s appointment as Punjab DGP, were dismissed by a Court led by Justice L Nageswara Rao.

“The Appeals are dismissed,” the Bench also comprising Justices BR Gavai and BV Nagarathna said.

The Apex Court reserved its order on the appeals after hearing all the parties on September 15.

On January 21, 2020, the Punjab and Haryana High Court suspended a Central Administrative Tribunal (CAT) ruling that had overturned senior IPS officer Gupta’s appointment as Punjab Police chief.

Mustafa and Chattopadhyaya challenged Gupta’s appointment on the grounds that they were “Ignored” despite being senior to Gupta, and a two-member CAT Court had ruled in their favor.

The Police Officers also disputed the empanelment Committee’s claim that the Officers lacked expertise in essential Policing areas, as stated in a report issued to the UPSC.

In his previous stint, Gupta was posted as the Director-General of Police, (intelligence) Punjab.
