Sessions Court acquits AAP former MLA in assault case

The sessions court has set aside the magistrate order and decided to acquit ex-MLA Manoj Kumar in an assault case of 2014 under IPC Section 352.

Additional Session Judge Geetanjali Goel passed the acquittal order and allowed Manoj Kumar to appeal and set aside the judgment of conviction dated 13.08.2019.

The Magistrate had earlier found Kumar guilty and punishable under Section 352 of IPC (punishment for assault or criminal force otherwise than on grave provocation).

It said that he was “a public servant and therefore it was his duty to behave fairly and courteously to those who approach him with their problems.”

The magistrate had, however, acquitted Manoj Kumar of charges under Section 354 of the IPC (assaulting woman with the intent of outraging her modesty).

The magistrate court said that “the intention and motive of the accused might be to shoo away the complainant on some issue, but not to insult or outrage her modesty.”
