SC to hear Amazon-Future-Reliance case on 20 July

The Supreme Court earlier today has adjourned the hearing of the petition filed by Amazon challenging the order of the Division Bench of the Delhi High Court.

This decision came after Senior Advocate Harish Salve informed the Court that the Tribunal will hear the application regarding the jurisdiction and main application to vacate the emergency arbitrator on 12 July.

The petition was moved by Amazon after the Division bench of the Delhi High Court stayed the order of a Single Judge Bench which allowed Amazon to enforce the emergency award against the Future-reliance deal.

The Single Judge bench allowed enforcement of emergency award after observing that the order passed by an emergency arbitrator is enforceable under Section 17(2) of the Arbitration and Conciliation Act.

In addition to this, the Bench further held that Amazon investment did not violate any law and thus the Future group has moved a vague plea inform of the Court thereby imposing a fine of Rs. 20 Lakh on the petitioners.

The Bench ordered the money to be deposited in the PM fund of Covid-19 within 2 weeks and to put the same on record within 1 week after such deposition.

After the Single Bench passed such orders, Future Group made an appeal in front of the Division Bench and the order of the single bench was put up on stay.

The matter is listed for further hearing by the Supreme Court on 20 July.
