SC Seeks Kerala Gov’s Response on Plea Concerning Desilting of Rivers Sands on Yearly Basis

The Supreme Court Bench consisting of Justice A. M. Khanwilkar and Justice J. B. Pardiwala while hearing the Special Leave Petition (SLP) issued Notice to State of Kerala.

The Petitioner made a plea seeking desilting of river sand before the monsoon arrives on the yearly basis as it happens for dam and reservoirs in Kerala.

The Petitioner earlier filed the Petition in High Court making the same Plea for distilling the river sand on the basis recommendation made by expert scientists.

The Petitioner made one more prayer before High Court, to direct State Government to build stock yard of such sand so that the public can get good quality sand at fair price.

The system of stockyard could be managed through District wise or Taluk wise.

The High Court refused to entertain this matter on the basis that mere paper reports cannot be the base of the Case and so Petitioner withdrew the Petition but High Court gave liberty to the Petitioner that fresh Writ Petition can be filed with supporting documents.

After hearing the Advocate V.K. Biju, the Counsel representing Petitioner, the Bench directed, “Issue notice, returnable on 11th July, 2022. Dasti, in addition, is permitted.”

The Supreme Court now sought answer from the Respondent-State.
