SC grants bail to Uday J Desai in Rotomac Scam Case

Supreme Court Bench consisting of Justices Sanjay Kishan Kaul and Hrishikesh Roy granted bail to Uday J Desai, director of Frost International Ltd on medical grounds in Rotomac Scam Case.

Additional Solicitor General Aishwarya Bhati, who was appearing on behalf of the Serious Fraud Investigation Office (SFIO), submitted before the Court that Desai can be granted bail on medical grounds.

 “After some initial arguments, learned ASG submits that the other aspects need not be gone into in the present proceedings as, on account of the two medical reports of the petitioner, the petitioner may be granted regular bail. We thus grant regular bail to the petitioner on the terms and conditions to the satisfaction of the Trial Court. The special leave petition is, accordingly, disposed of”, the Bench stated in its order.

Desai had filed Special Leave Petition against the Allahabad High Court order on March 25, which had refused to grant him bail.

The High Court had refused to grant bail to Desai based on the nature and gravity of the offence, which shakes the conscience of the society and public at large, and the fact that the investigation was still pending.

It was also noted by the High Court that there was strong apprehension about there being a high likelihood of evidence tampering by the applicants.

Uday along with Sujay Desai was arrested in the case involving an investigation into 11 companies of Rotomac Group and Frost International Ltd by SFIO.

Rotomac Scam involves Rotomac Group of companies committing alleged Rs 7,500 crore financial fraud with public sector banks and other institutions.
