SC directs govt. to set up National Tribunal Commission to appoint members in Tribunals

The Supreme Court has directed the government at the Centre to constitute the National Tribunal Commission to appoint members in different Tribunals.

A division in the Law Ministry should be formed to take care of and manage the Tribunals until the constitution of the National Commission.

The Top Court has also directed to appoint lawyers with ten years of practice as judicial members.

A Bench of Justices L. Nageswara Rao, Hemant Gupta and S. Ravindra Bhat heard a bunch of petitions challenging the constitutionality of the Tribunals, Appellate Tribunals, and other authorities (Tribunal Rules 2020).

Arvind P Datar, counsel for the Madras Bar Association, argued that the Rules were in “contravention of the principles of separation of powers, independence of the judiciary, and are against efficient and effective administration of justice.”

The Central government had notified the Rules in February 2020.

Earlier, Advocate Datar had argued that retired judges of the High Court and the Supreme Court should not take up the seats in the tribunals, barring the eligible candidates holding the post.
