SC directs Bulldozing of Illegal Twin Towers of Supertech

The Supreme Court directed the demolition of twin 40 floor towers in the Emerald Court project of Supertech Builders in Noida.

The Supreme Court upheld an order which was earlier passed by Allahabad High Court.

The order was passed because it was violating the Building norms.

A Bench comprising Justices DY Chandrachud and MR Shah observed that there was collusion between NOIDA officers and the builders.

The Court directed Supertech to refund the amount to all the buyers of the apartment with an interest of 12% per annum within 2 months.

It also impeached a fine of Rs 2 crore on the builder and asked to pay it to the Resident Welfare Association.

The Court also directed Supertech to complete the work of bulldozing within 3 months and it should be carried out at its own cost under the supervision of NOIDA officials.

In the order, Justice Chandrachud read, “The record of the case is replete with instances which shows collusion of Noida authority with the builder…Collusion is writ large in the case. High Court has correctly observed the collusion aspect.”

Further, the bench observed, “Illegal construction has to be dealt with strictly”.

The Bench also focused their concern on the need to preserve environment.

The Bench stated, “The protection of environment and well-being of the people who occupy this has to be balanced with the need of increasing demand for urban housing”.
