SC Directs Bihar Govt. to Frame Guidelines Regarding Arrest Akin to Guidelines Followed by Delhi Police

The Supreme Court while considering Section 41A CrPC asked the Bihar Government to implement guidelines regarding arrest, along the lines of those followed by the Delhi Police.

The Bench comprises of Justices Ajay Rastogi and Vikram Nath. The court also suggested that the government should ensure the implementation of the guidelines even with the help of amendments if required.

The Apex court, further, also asked the Patna High Court to consider implementing the suggestions given by the lawyers before the former regarding the methods to deal with the pendency of bail pleas and the issue of delayed listing at the high court.

The present case dealt with a criminal petition filed by Abhyanand Sharma who was arrested in February under the Arms act, IPC and Bihar Prohibition and Excise Act.

Even though the petitioner had filed for bail before the High court under Section 439 of the CrPC, the application had not been listed.
