SC denies Centre’s Petition opposing Delhi Govt Plan as issue is unresolved in HC

The Bench consisting of Justice L. Nageswara Rao and Justice BR Gavai refused to consider the Petition accounting to the fact that the impugned order is an Interim order and the same issue has been posted before the Delhi High Court on November 22.

The Supreme Court on Monday refuted to entertain the Special Leave Petition Filed by the Central Government against the September 27 order of the Delhi High Court that prepared the ground for the implementation of the Delhi Government’s doorstep delivery of ration scheme.

“We’re not inclined to entertain the SLPs since the matter is pending before the High Court”, the bench stated in the order.

The Court dismissed the matter seeking the High Court to conclude the issue on November 22 itself. The bench also observed that no parties will demand for postponement.

Senior Advocate Dr. Abhishek Manu Singhvi, representing the Government of National Capital Territory of Delhi, put forth the preparation for the scheme is under progress and it cannot be implemented within a week. The bench noted this submission.

At the same time, the Bench disposed the Petition filed by an organisation of fair price shop dealers opposing the High Court order.
