SC Allows OBC Quota in Madhya Pradesh Local Body Elections

The Single Judge Bench of Justice A M Khanwilkar had allowed the Madhya Pradesh Government to hold Local Body Elections with such Other Backward Class (OBC) Reservation as recommended by State Backward Classes Commission in their second report.

The State Government made submission that Court had objected first report and asked to revise it and accordingly delimitation is done and notified.

“For the time being, we permit the Madhya Pradesh State Election Commission to notify the programme for the respective local bodies keeping in mind the delimitation notification already issued as on date.i.e. till today and the report submitted by the dedicated commission…,” the Supreme Court ordered.

“We permit the State of Madhya Pradesh to notify the reservation pattern local body wise to be adhered to by the state election commission within one week. The state election commission shall notify the election programme in respect of the concerned local bodies thereafter within one week.” Court further added.

The Court earlier directed the State Government to hold Local Body Elections without OBC Reservation as state was lacking in doing triple test.

Eventually, the State Government move to Court seeking implementation of OBC Reservation as the revision of First Report took place.

The State Government has completed the Triple Test for Second Report which was made by keeping in Local Body OBC Reservation and the limit of 50 percent Reservation.

The Court made their stand cleared that this opinion will be considered final in future, if report will be challenged in future then decision of Court should be based on own merits as provided on Law.
