The Supreme Court sought the Attorney General of India, KK Venugopal to probe a petition concerning striking down of Section 124A of the Indian Penal Code.
According to Section 124A of the Indian Penal Code which criminalizes the offence of sedition, if any person expressly by words either spoken or written or by making any sign or virtual representation tries to create and spread hatred, disaffection and disapprobation towards the Government, the person shall be punished for life imprisonment with or without fine or can be imprisoned for three years with or without fine.
The bench headed by Chief Justice of India, NV Ramana directed the petitioner retired, Major General SG Vombatkere to send a copy of his plea to the Attorney General.
“You send a copy to the office of the Attorney General. We will hear it tomorrow,” the Court said.
The Apex Court has already taken a hold of another petition which challenges the validity of Section 124A of the Indian Penal Code.
Last year, a Constitutional bench comprising of Justices UU Lalit, Indira Banerjee and KM Joseph issued a notice to the Central Government in accordance to a plea filed by two journalists Kishorechandra Wangkhemcha from Manipur and Kanhaiya Lal Shukla from Chhattisgarh challenging the validity of the Section 124A as it violates the right of speech and expression.
