Rupam Pathak granted 15 days Parole by Supreme Court to attend Daughter’s Wedding

On Wednesday, the Supreme Court awarded Parole for 15 days to Rupam Pathak, who is serving a Life Sentence for the Murder of Purnia BJP MLA, Raj Kishore Kesari. She was Convicted for stabbing the BJP MLA to death in an open assembly at his residence in 2011.

The Supreme Court granted her Parole to attend her daughter’s wedding and directed her to Surrender after 15 days.

A Bench comprising the Chief Justice of India NV Ramana, Justice AS Bopanna and Justice Hima Kohli heard a Special Leave Petition (SLP) filed by Pathak challenging the decision of Patna High Court refusing to grant her Interim Bail for the reason that her Appeal against Conviction was still pending before the High Court.

The Advocate on Record representing the Petitioner was instructed to submit a copy of the Application for Parole, to the Central Bureau Investigation (CBI) when the matter was placed before the Chief Justice of India on Tuesday. Additionally, the Registry was instructed to inform the CBI to appear before the Court.

ASG Raju representing the CBI before the Court today informed the Bench that the Parole may be granted, as it has been ascertained that her daughter is getting married.

The Petitioner in her SLP stated that her appeal is not being heard by the High Court and is entitled for enlargement on Bail.

The Petition insisted that she has been framed in the present Case, as she got an FIR registered against the deceased as well as his secretary for offences of Rape.

The Petitioner also stated that she has been in Custody for 11 years and despite the Supreme Court’s Decision dated 18 October, 2013 neither was she granted Bail nor was her Appeal considered.

The Supreme Court in that Decision set aside the High Court’s Order to grant Bail to the Petitioner and made it clear that in case the request is made on behalf of the Petitioner for a Fast Track Hearing of the Appeal, then the High Court shall consider the same.

The Special CBI Court convicted Rupam Pathak, principal of local private school, who was later awarded Life Imprisonment for stabbing the BJP MLA to death. However, she is persistent on the Allegations of Sexual Harassment by the MLA and his secretary.
