Rajenthra Bhalaji’s sudden Arrest: SC questions Tamil Nadu Government’s action

On 6th January 2022 the Supreme Court of India questioned the Tamil Nadu Government regarding sudden Arrest of former Minister K T Rajenthra Bhalaji while his case was yet to be heard by the Supreme Court.

The Additional Advocate General V Krishnamurthy representing the Tamil Nadu State Government was questioned by the Chief Justice of India, who asked “Is it proper for your Government to Arrest him when the matter was pending before the Supreme Court? Would heavens have fallen otherwise?”

Justice Surya Kant asked “Is it your intention that the Supreme Court should be deprived of a hearing?” and Justice Hima Kohli further contended “Why are you in a hurry?”

In response of the Supreme Court Bench’s questions, Counsel for the State Government of Tamil Nadu argued that the Madras High Court had declined to grant Mr. Bhalaji an Anticipatory Bail and stated that “He was Arrested. He has been remanded in Judicial Custody.”

The Counsel for the Accused Rajenthra Bhalaji, Senior Advocate Dushyant Dave submitted that not only was client Arrested suddenly by the Police but also that the Police even Raided the houses of the Lawyers representing Mr. Bhalaji.

The Chief Justice of India N V Ramana questioned the State Government of Tamil Nadu regarding the complaint of the Advocate of Mr. Bhalaji, “Why are you attacking the Lawyers? Is this the way? What are we coming to?”

The Three Judge Supreme Court Bench then issued a notice in this regard and decided to hear the matter on January 10, 2022 and also put a Stay on further Orders against Mr. Bhalaji.
