Rajasthan High Court Suspends Circular to Resume Hearings in Hybrid Mode

Rajasthan High Court dismissed the circular to resume regular hearings in Hybrid Mode. It has now decided to continue to take up cases only through video conferencing till July 2, 2021. 

Earlier, Rajasthan High Court passed the circular to resume hearings of cases in a hybrid mode from June 28. This decision came out after a gap of almost three months due to a rise in Covid-19 cases in the State. 

The High Court decided to permit entry in the premises of the Court to those who have completed 14 days after the second dose of Covid-19 vaccination.

The Bar Council of Rajasthan opposed the circular. Addressing a letter to Chief Justice of Rajasthan HC, Advocate Kuldeep Kumar Sharma, Chairman of Bar Council of Rajasthan stated that, “The restriction of advocates to enter into the Court premises has no proper reasoning as a majority of the lawyers are not vaccinated for 2nd dose across the State for the circumstances beyond their control. Kindly consider that there is no such restriction by the State for movement of an individual.”

In reply to this letter, Rajasthan High Court issued the Order on June 27, stating, “In partial modification of this office’s previous Notification dated 24.06.2021, it is hereby notified that from 28.06.2021 to 02.07.2021, Clause-1, 2, and clauses related to, in the above Notification shall remain suspended. During this period, regular hearing of cases in Rajasthan High Court shall be only through video conferencing. Other conditions of Notification dated 24.06.2021, shall remain the same.”

The Subordinate Court has issued similar directions to that of the High Court. They shall resume the regular hearing of cases only through video conferencing.
