R-Day Violence: Delhi Court grants Anticipatory Bail to Lakha Sidhana

A Delhi Court allowed gangster-turned-activist Lakha Sidhana Anticipatory Bail in a case involving his alleged role in the violence that erupted at the Red Fort on Republic Day, stating that no case has been made out against him.

After his interim protection from arrest expired on Thursday, he was granted Anticipatory Bail by a Sessions Court.

There is no prima facie evidence that Sidhana was present within the Red Fort, according to Additional Sessions Judge Kamini Lau, and “If that be so, even no case is made out against him.” 

The Court further stated that the Investigating Officer (IO) is unable to explain why the accused’s custody is necessary for the inquiry.

On a personal bond of Rs. 50,000 and one local surety of the same amount, the Court granted him pre-arrest Bail.

The police had objected to the plea, claiming that he was a key conspirator in the violence and a noticeable face at the Singhu Border during the Riots.

 “Sidhana was very well versed with the route provided by the Delhi Police to farmers for their protests, but accused in complete violation and disregard of the guidelines instigated the mob not to follow the permitted route,” the prosecutor told the Court.

However, his lawyer, Jasdeep Singh Dhillon, told the Court that there isn’t a shred of proof that he committed any violence or incited anyone else to do so.

It was previously stated that Sidhana had no involvement in the Red Fort incident and that the police have confessed that Sidhana never entered the Red Fort on January 26, 2021.

In a separate case (FIR 39/2021), the Court has extended Sidhana’s interim protection until August 9.
