The Punjab and Haryana High Court granted Bail to a Juvenile after allegedly Raping a woman older than him.
The Court granted the Bail after it was submitted by the Legal and Probation Officer that the Offence was committed by him under the ‘Influence of his company.’
The Court allowed concession on the condition that the juvenile’s parent would provide Education so that he gets gainful Employment.
The Court remarked, “The parents of the Petitioner shall file an Affidavit to this effect Principal Magistrate, Juvenile Board, Nuh.”
The Court further observed that if the parents of the Accused are not able to keep him away from people with Criminal Antecedents and Dangerous behavior, the Bail shall be Cancelled.
Justice Manjari Nehru Kaul passed this Order while allowing a Revision Petition filed by a child in conflict with Law from Nuh who sought Bail in a Rape Case.
As per the Allegations, In March 2020, the Accused dragged a woman, above 18 years of age into a car along with others and allegedly Raped her.
