Punjab & Haryana HC Orders Departmental Enquiry Against DSP for Providing False Information

The Punjab and Haryana High Court has taken a strong stance against the routine practice of furnishing false information in court and directed the initiation of a departmental inquiry against Deputy Superintendent of Police (DSP) Shri Mukesh Kumar from Haryana’s Tauru.

The court’s decision came in response to a bail application related to a case involving a scuffle between two groups in a village, resulting in gunshots and the deaths of two individuals. In the bail petition filed by one of the accused, the court requested a status report from DSP Shri Mukesh Kumar.

However, the status report provided by the DSP contradicted the findings of the Forensic Science Laboratory (FSL) report, which indicated the recovery of a bullet from one of the deceased.

Justice Deepak Gupta, presiding over the case, noted that it has become a common practice to provide false information in court in numerous cases. He directed the Director General of Police (DGP), Haryana, to proceed with a departmental inquiry against the DSP for submitting a false affidavit to the court.

The counsel representing the State apologized on behalf of the DSP, acknowledging that the status report had been filed based on incorrect information. The court has scheduled the matter for further consideration on November 9.

The court’s decision reflects its commitment to ensuring the accuracy and truthfulness of information presented in legal proceedings, aiming to maintain the integrity of the judicial process.
