Bombay HC allows Anticipatory Bail to Policeman accused of rape

Bombay High Court allowed interim pre-arrest bail to a Police Sub-Inspector who was charged in a rape case based on the information given by a 22-year-old victim who resided in another city.

“The victim met the accused on a social media platform and they became friends and it appears their love for each other grew over a sufficient period of time.”, states the High Court in its Order. The court noted that physical relations were regular over the years.

An Additional Public Prosecutor, HJ Dedhia, stated that the Complainant had not appeared in the Police Station despite several letters which were returned ‘unclaimed’.

Justice S.K. Shinde ordered the Prosecution to make efforts to trace the presence of the Complainant for further investigation in the matter. The Court adjourned the anticipatory bail plea to September 3 for further hearing.

The HC in its order also noted that the Prosecutrix had even stayed with the applicant at different places. She also alleged that the applicant had declined to marry her because she belongs to another caste.

After hearing the Counsel of the accused High Court issued Orders against the arrest of the accused till the next date and stated that if arrested the accused will be released on a bond of Rs 25,000 along with sureties.

The High Court ordered the accused to join the Investigation and not tamper with the evidence or try to contact the victim, witness, or any other person associated with the case in any possible circumstance.
