Plea in Supreme Court requesting Fair Investigation in Noida Attack Case

On Friday, the victim of the Noida attack crime Case has moved a Petition in the Supreme Court, through which he has demanded a fair, just, and impartial investigation.

Kazeem Ahmad Sherwani, the Petitioner also requested the Court to take appropriate actions against those Police Officers who refused to lodge a complaint on his behalf.

The Petitioner also claimed that he was just attacked because he belonged to Muslim Community.

A Bench comprising Justices AM Khanwilkar and CT Ravikumar tagged the said Petition with all other Writ Petitions dealing with the issue of hate speech.

“There are other matters of hate speech pending. We’ll list along with that,” stated Justice Khanwilkar during the hearing.

However, when Senior Advocate Huzefa Ahmadi, who was appearing for the Petitioner requested to consider this matter immediately, the Court replied that, “Some arguments have been made in that also. All of them will overlap.”

Adding to this, the Court also stated that this matter will only be decided when  it will be heard with the batch of Petitions.

The Court made all these statements while hearing a Petition filed by 62-year-old man Mr. Sherwani.

In his Petition, Mr. Sherwani contended that despite several representation, neither the Police Authorities nor the National Human Rights Commission took any action against the made complaint.

“On the contrary, the Police have sought to dissuade the Petitioner from pressing his complaint by exerting unwarranted pressure on him and members of his family. It is the duty of the police to bring the perpetrators of the crime to justice.Unfortunately, by not registering FIR immediately and not swinging into immediate action, the concerned police officers have failed to perform their duties,” added the Petition.

The Court after hearing this matter tagged the Petition with other Writ Petition involving same matter.

It should be noted here that the Court gave liberty to the Petitioner to serve advance copies to the Standing Counsel of the Respondents.
