The District and Session Judge Rajiv Bharti allowed Revision of two Pleas which was earlier dismissed. One Plea seeks ownership of Idgah land and other for demolition of Idgah filed by ‘Devotees’.

Judge Bharti while allowing the Plea for ownership of land of Idgah observed that the Places of Worship Act, 1991 is not obstructing the Plea filed against the agreement between shahi Idgah and the Srikrishna Janmabhumi temple.

“With regard to the entire property of Katra Keshav Deo, whether Shri Krishna Janma Bhoomi Seva Sangh had the power to enter into compromise with Trust Masjid Eidgah is a matter of Evidence, which can be determined only on the basis of Evidence adduced by both parties during the Trial,” the Court has held.

The premises of Karta Keshav Dev temple is considered to be the birthplace of Lord Krishna. By the Decision of Judge Bharti lowered Court is allowed to be heard.

Earlier Civil Judge Chaya Sharma in 2020 dismissed the Plea on the basis that Petitioners have no Locus Standi over the Case.

The Case was filed by the Advocate Ranjana Agnihotri with other six people as ‘Next of Kin’ of deity, Sri Krishna Virajman.

“…This Court is of the view that a worshiper as the next friend of the deity can file suit for restoration and re-establishment of religious rights of the deity,” the District Court held.
