The Madras High Court on Monday issued notice in a Public Interest Litigation (PIL) asking for an alternative to be given to furnish mother’s name or the single parent’s name in forms, government documents, court affidavits.

A Division Bench of Chief Justice Sanjib Banerjee and Justice PD Audikesavalu asked the Central Government and Tamil Nadu Government Authorities file Counter Affidavits in four weeks’ time.

The petition was filed by an Advocate B. Ramkumar Adityan, arguing that none of the application has an option to furnish mother’s name only, which is violation of the Principle of “Equality” mentioned under Article 14 of the Constitution.

The petitioner demanded that both men and women be treated equally in such matters. The petition also referred to Article 2 of the Universal Declaration of Human Rights.

The petitioner raised several points as to how women are constantly pressured to obtain absentee husband’s name, even after divorce, several institutions demand father’s signature for the student’s identification, the issuance of Aadhar Card without stating mother’s name, etc.

However, after making number of representations to both the Central government and Tamil Nadu government and eventually being failed to receive a positive response, the High Court was approached.
