Petition seeking directions for general rules for district courts filed in Delhi HC

The Delhi High Court on June 4, 2021 sought response from the Registrar General of Delhi High Court and the Delhi Government, while considering a petition seeking directions to issue general rules for regulation of practice in District Courts.

The petition filed by Abhijit Mishra pleaded to invoke writ of mandamus for rules/regulations for the district courts, subordinate to the High Court for the benefit of litigants and advocates.

The petitioner while highlighting various infrastructural shortcomings in subordinate court submitted that there is a need to upgrade the same for the Phase III of the E-courts project of the Apex Court.

The petitioner further submitted that, the High Court has not issued any notification for the registration of the applications in the court cases of the District Courts under the backing of Article 227 of the Constitution or Code of Civil Procedure 1980 or Code of Criminal Procedure, 1973.

The petition further contended that there are various fallibilities in the subordinate court which hamper the administration of justice, and limits the efficiency of the litigants devoting their time in the same.

The Petition enumerated various loopholes such as non-generation of Diary nos. of filings, Interlocutory Application nos. and even no proper provision of online submissions of pleadings and requesting of orders.

Acknowledging that the lower courts are the responsibility of the High Court, the Bench issued a notice in the non-adversarial plea and listed the matter for further hearing on August 16.
