Pennsylvania’s apex court has quashed a lower court’s order barring the state from endorsing several contests on the November 3 election poll in a suit filed by the Republicans challenging President-elect Biden’s victory in Pennsylvania.
The Supreme Court, unanimously dismissed the order, stating that the lawsuit was filed months after the law allowed for challenges to the state’s year-old mail-in voting law.
The lawsuit was led by Republican Mike Kelly of north-western Pennsylvania. He had claimed the state’s year-old mail-in voting law as unconstitutional.
The plaintiffs (Republicans) had sought to either annul the election results and direct Pennsylvania’s Republican-led Legislature to select the state’s presidential electors or to throw out the 2.5 million mail-in votes tendered under the law, which were mostly by the Democrats.
Joe Biden had beaten Donald Trump exceeding 80,000 votes in Pennsylvania.
Democrat Josh Shapiro, who is the state’s attorney general, described the top court’s decision as “another win for Democracy.”
