Patna High Court Dismissed the PIL that Sought to Impose Penalties on those Involved in Agnipath Protest

During protests in Bihar against the Centre’s Agnipath scheme for short-term military recruitment, the Patna High Court received a PIL that sought to impose penalties on those involved in vandalism as well as the state government and political parties in Bihar for losing and damaging public property, particularly railways.

The division Bench of Chief Justice Sanjay Karol and Justice S Kumar disposed of the PIL while refusing to interfere judicially in this matter.

The state police, according to the petitioner, should have stopped the vandalism that was endangering people’s lives.

He noted the miscreants’ damage at the Danapur railway station, which resulted in an estimated loss to the railways of Rs260 crores.

Advocate general Lalit Kishore submitted that the PIL was premature as the state government had been taking stringent action against the identified culprits and erring police officers.

After hearing the arguments, the Court declined to get involved, noting that since the state government is already taking action against those named for causing a commotion, there is no need for any judicial interference in how the state runs its affairs.
