Orissa High Court grants Bail to men Conspiring Assault against Former CJI SA Bobde

The High Court of Orissa grants bail to a man who was accused of sending a message in a WhatsApp group making people conspire to assault with shoes to the former Chief Justice of India for being refused permission to observe Rath Yatra.

Last year, on June 18th the bench of Supreme Court headed by CJI SA Bobde looked at the situation of the country due to a pandemic directed that no rath yatra should be held. Later the Court modified its judgement and allowed Rath Yatra at Puri.

Earlier this week, the Court dismissed petitions seeking permission to conduct Rath Yatra, the petitions were dismissed in order to state that the country is still recovering from the impact of the second wave of COVID-19.

The National Chairman of Dharma Rakshyak Shri Dara Sena, Mukesh Jain has portrayed the Chief Justice of India as a Christian terrorist, a Naxalite and has accused him of halting the Rath Yatra.

Charges framed against him are under Sections 153/153-A/153-B/295-A/504/505/506 of the Indian Penal Code read with Section 66(F) of the Information Technology Act.

Jain reportedly said to the Court that there are different cases registered in different police stations against him in the country for the aforementioned WhatsApp message and that he was granted bail in those cases.

The state contended that the charges are grievous having an impact on society hence he should not be granted bail.

Justice SK Panigrahi, considering the fact of him getting bail in two cases and also the length of his detention granted him bail by imposing certain conditions to his bail.
