Despite the complainant lady indicating that she had no issue with the Case being closed, a Mumbai Magistrate Court recently rejected the Police’s Closure Report in a Rape Case against T-Series’ Chairwoman and Managing Director, Bhushan Kumar.

The inquiry was unusual, according to Metropolitan Magistrate RR Khan, in that neither the Investigating Officials nor the accused requested arrest or Anticipatory Bail after the Case was recorded.

A 30-year-old lady submitted a complaint in July, and the Case was started.

When the Police classify the Case as wilfully false or when there is no Evidence or a Prima Facie Case against the accused following an investigation, a closure report, also known as a “B summary” report, is prepared.

After receiving the notification, the survivor filed an Affidavit alleging that the claims were made by her as a consequence of a circumstantial misunderstanding. As a consequence, she desired to retract her accusations and had no issues to the acceptance of the B-Summary report.

However, Mallikarjun Pujari, a third individual, filed a protest Appeal against the Report’s clearance. Various papers were annexed, including the survivor’s First Information Reports and a letter she addressed to him in support of his Plea.

These actions, according to the Court, revealed Bhushan Kumar’s willingness to handle the problem as quickly as possible.

As a consequence, the Court ordered the police to begin a Legitimate inquiry. It also ordered the probe to be closely monitored by the Zonal Deputy Commissioner of Police (DCP).

The Court also ordered the Additional Public Prosecutor (APP) to take legal action against the complaint for breaking the law. It also instructed the Additional Public Prosecutor to notify the Mumbai Commissioner of Police and the State Director General of Police about the Investigators’ activities.
