Man Sent to Jail and Fined Rs. 2000 for Contempt of Court Order

The Single Judge Bench of Justice Subramonium Prasad pronounced 45 days Imprisonment to a man who Contempt the Court’s Order by demolishing wall of boundary by JCB excavator.

The Delhi High Court opined that this incidence shows that contemnor has no respect towards Court and intention to frighten the other party.

The Hon’ble Judge noted that he lowered the Dignity of Court and Law.

“The purpose of Contempt Jurisdiction is to uphold the majesty and dignity of the Courts of Law, since the respect and authority commanded by the Courts of Law are the greatest guarantee to an ordinary citizen and the democratic fabric of society will suffer if respect for the Judiciary is undermined,” the Single-Judge stated.

The Court refused to grant mercy as to show importance of Court’s Order so that society will also get a message that force cannot be used to dishonour the order.

Petition was filed by Nirmal Jindal. The Court in 2020 passed the order in her favour to construct the boundary around the land which is disputed but condition was that Revenue Department can demolish it on finding that property belongs to other party.

Police protection was also given to her by Court but on January 3, 2022 the boundary was demolished by contemnor.

The Court rejected an unconditional apology filed by contemnor by observing that his act was wilful to Dishonour Court and demolition took place after a year of construction and he was in person present in the Court at the time of passing the Judgment.

The Court along with Imprisonment also imposed Rupees 2000 Fine.
