Madurai Court acquits three, citing delay in receiving FIR

The Madurai Bench of Madras High Court acquitted three convicts sentenced to life imprisonment for attempting to murder a man who helped a couple in their inter-caste marriage.

A Bench, comprising Justices V Bharathidasan and J Nisha Banu, observed, “While a mere delay in filing a First Information Report (FIR) may not be fatal to the prosecution, it raises suspicion when it is coupled with a delay in delivering the FIR copy to the Court.”

The Court stated that the eye-witnesses in the case were untrustworthy, and two previous statements made by eye-witnesses, which included a traffic police, who was on duty near the place of incident, were suppressed.

The Bench further added that it may look like an attempt to ‘build up a different case’ to implicate the accused.

The Court acquitted the trio since the prosecution failed to provide a reasonable explanation.

The order was made in response to the trio’s appeal of their conviction by a Lower Court in 2018.
