Madras High Court orders probe into False Motor Accident claims

The Madras High Court on January 24, 2022 ordered a probe relating to several cases in courts regarding false motor accident claims. There are around 84 cases that are allegedly fake.

The matter is pertaining to 84 claims that were dismissed and pressed. The Madras High Court Judge N Anand Venkatesh stated that “This is not merely coincidental and it is more a knee-jerk reaction after complaints were made to the effect that claims have been filed with false and fabricated medical and hospital records of Cavery Hospital, Hosur.”

Justice Venkatesh further stated that “It is not clear as to whether the concerned Judges before dismissing the 84 claims as not pressed, even conducted any preliminary enquiry to ascertain as to why so many claims are not pressed.”

A Status Report was filed by the Assistant Inspector General of Police regarding the false claims. In the Report the Assistant Inspector General sought more time in order to complete the investigation, this was allowed by the Court.

An Additional Affidavit filed by respondents stated, “There are several instances of even 108 Ambulances being driven to a private hospital, very nearly hijacked, one can say, after recording Accident Register copy in a government hospital, for the record. This has a critical and detrimental impact on trauma care, during the “Golden Hour” in the treatment to victims.”

The Court also stated that “For this purpose, this Court also wants to Suo Moto implead the Secretary, Tamil Nadu State Legal Services Authority as a party to the proceedings to help the cause of the genuine claimants.” The matter is listed on April 4, 2022.
