Madras High Court: Life of Interim orders extended till 15 July

Extending the earlier order passed on 17 May; a Bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy has extended the life of all interim orders until 15 July.

Though the Court stated that the order and the situation will be reviewed on 12 July, the Court exercising its power under Article 226 and 227 of the Constitution of India, Sections 482 and 483 of the Code of Criminal Procedure and Section 151 of Code of Civil Procedure passed various directions on 17 May.

The Court had earlier extended all the interim orders passed till 30 May which included the Orders by Madras High Court which were priorly subsisting on 30 April, the  Orders of eviction, dispossession and demolition that were not executed and the Orders passed exercising criminal jurisdiction including that of bail, anticipatory bail, and parole.

It was further directed that the directions and orders were subject to the contrary that are or might be passed by the Supreme Court thereby giving fair chance to the aggrieved party to apply for discharge or discontinuation in case of hardships for continuing the interim order.

The Court also added that the directions that were already issued for a limited time period will remain unaffected by the order. Even the encroachment drives relating to demolition and eviction were declared to be kept aside for a temporary period of time.

In conclusion, the Court stated that all the remand orders will also be extended without any prejudice to the rights of an arrested person thereby making it possible to continue in the mode of either in person or video conferencing and to revive the High Powered Committee to look for the release of prisoners so that the prisons are not overcrowded in the times of pandemic
