Madras HC quashes Criminal Defamation case against DMK Leader

The Madras High Court quashed a Defamation case (criminal) filed against DMK Leader Kanimozhi Karunanidhi for criticizing the previous AIADMK Regime’s Chief Minister Edappadi Palaniswami.

In the year 2018, Kanimozhi participated in a DMK-led protest in Villupuram where she criticized the then Chief Minister. Further, a Defamation Case was filed against Kanimozhi in the Villapuram District Court for hurling Corruption charges at Palaniswami in connection with waste disposal.

Kanimozhi approached the High Court and filed a quash Petition in 2019. In the Petition, Kanimozhi argued that she was misunderstood and a complaint was filed against her which was based on Hearsay two witnesses who attended her speech.

Furthermore, Kanimozhi contended that no public servant had absolute immunity from criticism from the Opposition along with the Public. Senior Advocate P. Wilson, appearing for Kanimozhi.

After DMK came into Power, Chief Minister M.K Stalin ordered the withdrawal of all the Defamation cases filed by the previous Government in power.
