The Madras High Court issued a directive directing the Principal Secretary to Government, Home Department to take urgent action to remove uniformed personnel acting as orderlies at the homes of higher authorities and to employ these forces for the benefit of the general public.
The court was commenting on the petition about an illegal overstay in government housing when it made the aforementioned points.
Justice SM Subramaniam took note of a departmental government decision that was issued in 1979. The state acted in accordance with the Central Government’s decision, which was made at the chief minister’s conference. This Government Order has been in effect for more than forty years, but it has not been put into practice.
The court also pointed out that it has been introduced and has been revoked in numerous other states. Unfortunately, the orderly method has not been used in Tamil Nadu despite being abolished for more than 40 years.
The court noted that all India Service Conduct Rules,1968 clearly stipulate that the, “misuse of an official position is misconduct and it states that refrain from doing anytjing, which is or may be contrary to any law, rules, regulations and established practices.”
Therefore, the principal secretary to government, home department was mandated to institutite appropritae disciplinary proceedings in the event of any violation of the government orders or commission of misconduct under the All India Services Conduct Rules, 1968.
