Madras HC Denied Anticipatory Bail to Tamil Actress Charged with Making Objectionable Remarks Against CM

Tamil actress Tamilselvi alias Meera Mithun, charged with making Obscene and Indecent remarks against Chief Minister MK Stalin in a WhatsApp group discussion with the creators of her next film “Peiya Kaanom,” had her Anticipatory Bail Application refused by the Madras High Court.

The actress was also Ordered to be Arrested and an Investigation into the Case was ordered by Justice G Jayachandran’s Bench.

The actress had applied to the High Court for Anticipatory Bail under Sections 294(b), 153, 504, 505(i) (b), and 506(i) of the Indian Penal Code, as well as Section 67 of the Information Technology Act. The Case was initiated in response to a complaint filed by producer Surulivel, whom she had also made disparaging statements.

The actress claimed in her Petition that she was at a funeral at the time of the alleged event. She also stated that she was wrongly accused of being involved in the Case because she had requested payment from the producer. The producer has threatened to file a bogus complaint against her, according to her. She maintained that she was not involved in the alleged incident and that she was completely innocent.

When the Court asked if the actress had been arrested before, the Government Lawyer said she had been previously arrested in a Hate Speech Case that had been registered under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act of 1989 and had been freed on Bail. After hearing all sides, the Court decided not to give the actress Anticipatory Bail and Ordered the police to continue their Investigation.
